South African Immigrants

In excess of one hundred thousand immigrants arrive in South Africa each year and many of these immigrants have a need to transfer money back to their home country or another overseas jurisdiction. Below we look at the impact of the exchange control regulations on South African Immigrants making money transfers out of South Africa.

Definition of an Immigrant

For the purposes of foreign exchange an immigrant is classified as “a natural person who has immigrated from south african immigrants transferring moneycountries other than Lesotho, Namibia and Swaziland with the firm intention of taking up or having taken up permanent residence in the Republic”.

Rules upon arrival

  • A declaration must be made as to any foreign assets owned and confirming that such assets will not be placed at the disposal of any 3rd party South African permanent resident.
  • Proof must be provided to an authorised dealer of the residency and they will be regarded as immigrants from the date of entry into South Africa.
  • Where South Africans have been abroad for a period of more than 5 years they will be treated the same as immigrants, provided they formally emigrated when they left South Africa.

Concessions

  • Existing foreign assets – Immigrants with foreign assets, providing they have completed the required declaration and undertaking, are allowed to dispose or otherwise invest their foreign assets, including foreign cash funds held by them, subsequent accruals and income without interference from the Financial Surveillance Department.
  • Repatriation of Money transferred into South Africa within 5 years of immigration – as long as it is within a 5 year time period (of the immigration). individuals are allowed to repatriate all own assets introduced during this period. It must be proven that the assets were introduced from abroad and not financed with local assistance and that such transfers are not financed out of local financial assistance.
  • Transfer of money out over and above the amount introduced within 5 years – individuals are able to transfer abroad their remaining South African assets, over and above assets introduced from abroad, provided that they are able to prove they are leaving South Africa permanently. Furthermore it must be proven that the assets to be transferred are reasonable in relation to the growth resulting from such individual’s business/employment activities and/or are market related. Such transfers may also not be financed out of local financial assistance.
  • Repatriation of Funds after 5 years of immigration – After 5 years immigrants will be regarded, on departure, as normal emigrants from South Africa and will only qualify for the prescribed emigration facilities, except for immigrants who immigrated to South Africa on or after 13th March 1995, who will also qualify to repatriate all own assets previously introduced/imported.
  • Other concession are also available – where commitment was made prior to arrival in South Africa and all necessary undertakings have been signed:
    • Foreign currency life insurance policies.
    • Contributions to pensions.
    • Contributions to medical aid funds.
    • Loans that can not be paid for from funds abroad and whereby the loan was specifically to finance the immigration to South Africa.
    • Tax bills where funds are not available abroad.

Although not unique to South Africa very few countries now operate a system of control (exchange control regulations) over money movement in and out of the country (currency exchange).

South Africa Exchange Control regulations ‘control’ the flow of money both in and out of South Africa. They effect every transaction, no matter what amount of rand gets transferred and who the sender or recipient of the money is.

The Reserve Bank of South Africa controls and oversees all capital in – and outflows. The Reserve Bank designates power to authorised dealers (banks) who oversee and regulate the market on their behalf.

How do exchange control regulations effect me?

For individuals the South African exchange control regulations dictates how much and under what circumstances you may transfer money out of South Africa. It should be noted that the exchange control regulations apply to South African residents, not citizens or permanent residence holders. Therefore if you are considered a resident for exchange control purposes, they are applicable to you. Residency is defined in a number of different ways and expert opinion as to your circumstances should be sought from a company such as ours.

South Africa operates a system of exchange control over the flow of money into and out of South Africa. For every money transfer that is effected exchange control plays a role. Below we look at some of the processes and parties invovled in how foreign exchange control works.

Parties

  • The Reserve Bank of South Africa – Is empowered by the presidency in terms of overseeing and regulating certain matters that directly or indirectly relate to or affect or have any bearing upon currency, banking or exchanges
  • Authorised dealers – Their function is to assist the Financial Surveillance Department in administering exchange control. All applications to the Financial Surveillance Department have to be made through an authorised dealer. In other words: all currency transactions must go through authorised dealers, however and importantly you do not have to trade your currency through them.
  • Currency Companies – Currency companies, such as Incompass, work with authorised dealers. They are able to get better rates and do not charge administration fees through a process of bulking. In practise this means that due to the large amount of trades that we transact we are able to provide more competitive rates of exchange as well as expertise due to specialising.

But it is also not true that funds that were introduced to South Africa can never be transferred back again. To repatriate funds, clearance must be obtained from the authorised dealer (and possibly the Reserve Bank). Repatriation depends on a number of criteria that includes but is not limited to:
    • Why, when and how the funds were transferred to South Africa;
    • Residency status;
    • How long you have been in South Africa;
    • Tax status.

In the instance of repatriating funds it is highly unlikely that any currency company that is not based in South Africa will be able to assist you.
