Paul and Kirsteen, just a quick note to let you know that our transfer came through yesterday.

Thank-you very much for your professional and prompt service, it was a real pleasure dealing with both of you.

I will definitely use your services in the future and recommend your company to others.

Regards,

Paul

Dear Paul,

I am impressed and feel well supported by your company. I am very glad my son suggested that I go this route!

I saw Fiona very briefly beginning of October and know at least where you are situated. It all helps to have a face to a name.

I am keen to get the best rate possible but I am very aware of the financial ‘mess’ Greece is in and the impact that it has on the global financial situation. This still is not answering your question of what rate I am hoping for…

Paul, I would love it to go below 12. I know I have time till the end of the year.

Once more thank you for keeping me posted!

Erma

Hi Nick,

I just wanted to let you know how pleased I am with the service that I get from Stacey with regards to the management of my Investec Account. Thank you for suggesting the account in the first place, and a big thank you for sending Stacey my way!!! She is brilliant.

Kind regards,

Michèle

Dear Cheryl & Kirsteen,

I would like to extend a warm heart filled with thanks for the smooth way you guys do business.

You guys take the stress and worry completely out of the equation, which is almost unheard of these days.

I would whole heartedly recommend Incompass to anyone who would need such a service.

I would just like to say how good it feels to get such a lot in such a short time done. It wouldn’t be possible without the team at Incompass!! Your help is much appreciated.

Kind Regards,

Neil

  • Proof must be provided to an authorised dealer of the temporary residence

Concessions

  • Existing foreign assets – foreign nationals with foreign assets, providing they have completed the required declaration and undertaking, are allowed to dispose or otherwise invest their foreign assets, including foreign cash funds held by them, subsequent accruals and income without interference from the Financial Surveillance Department.

Why choose Incompass for your money transfer to South Africa for property purchase?

  • Banking – many of our overseas clients purchasing property have yet to formalise their banking arrangements in South Africa, for those who have it is often a simple current account. Incompass is able to open up high interest private style banking for its clients prior to their arrival in the South Africa. This provides numerous benefits that include:
    • High Interest rates – Having a secure high interest bearing account to which you can transfer you money to. Many house buyers transfer their purchase money to an attorneys trust account which offers poor interest rates and no access.
    • We are able to provide you with bank guarantees – when purchasing a property in South Africa it is common that you will have to provide a bank guarantee that the funds are available.
    • Private style banking – you are provided with your own personal banker who can be instructed to pay on your behalf deposits, bills and even standing orders and direct debits. Allowing you to effectively run your account via your personal banker for any outgoings you may have to pay.
  • Declaration of Assets – an often overlooked but vital part of the process for transferring money into South Africa. A failure to correctly declare your assets can result in unnecessary taxation and difficulties in repatriating funds.
  • Compliance with the South African Reserve Bank regulations – South Africa operates a system of exchange control that effectively regulates the flow of all money in and out of South Africa. There is a common misconception that whatever money is brought into South Africa can automatically be taken out – this is not the case. It is essential that any currency transfers into South Africa are done in accordance with the appropriate rules and regulations and a failure to do so will cause issues later on if you wish to repatriate your introduced currency. It is highly unlikely that banks or currency companies based abroad are aware of these regulations.

South African Immigrants

In excess of one hundred thousand immigrants arrive in South Africa each year and many of these immigrants have a need to transfer money back to their home country or another overseas jurisdiction. Below we look at the impact of the exchange control regulations on South African Immigrants making money transfers out of South Africa.

Definition of an Immigrant

For the purposes of foreign exchange an immigrant is classified as “a natural person who has immigrated from south african immigrants transferring moneycountries other than Lesotho, Namibia and Swaziland with the firm intention of taking up or having taken up permanent residence in the Republic”.

Rules upon arrival

  • A declaration must be made as to any foreign assets owned and confirming that such assets will not be placed at the disposal of any 3rd party South African permanent resident.
  • Proof must be provided to an authorised dealer of the residency and they will be regarded as immigrants from the date of entry into South Africa.
  • Where South Africans have been abroad for a period of more than 5 years they will be treated the same as immigrants, provided they formally emigrated when they left South Africa.

Concessions

  • Existing foreign assets – Immigrants with foreign assets, providing they have completed the required declaration and undertaking, are allowed to dispose or otherwise invest their foreign assets, including foreign cash funds held by them, subsequent accruals and income without interference from the Financial Surveillance Department.
  • Repatriation of Money transferred into South Africa within 5 years of immigration – as long as it is within a 5 year time period (of the immigration) individuals are allowed to repatriate all own assets introduced during this period. It must be proven that the assets were introduced from abroad and not financed with local assistance and that such transfers are not financed out of local financial assistance.
  • Transfer of money out over and above the amount introduced within 5 years – individuals are able to transfer abroad their remaining South African assets, over and above assets introduced from abroad, provided that they are able to prove they are leaving South Africa permanently. Furthermore it must be proven that the assets to be transferred are reasonable in relation to the growth resulting from such individual’s business/employment activities and/or are market related. Such transfers may also not be financed out of local financial assistance.
  • Repatriation of Funds after 5 years of immigration – After 5 years immigrants will be regarded, on departure, as normal emigrants from South Africa and will only qualify for the prescribed emigration facilities, except for immigrants who immigrated to South Africa on or after 13th March 1995, who will also qualify to repatriate all own assets previously introduced/imported.
  • Other concession are also available – where commitment was made prior to arrival in South Africa and all necessary undertakings have been signed:
    • Foreign currency life insurance policies
    • Contributions to pensions
    • Contributions to medical aid funds
    • Loans that can not be paid for from funds abroad and whereby the loan was specifically to finance the immigration to South Africa
    • Tax bills where funds are not available abroad.

All of our transactions are processed through local banks, that are approved authorised dealers by the South African Reserve Bank. In addition we are an FSB (Financial Services Board) registered company holding all appropriate licences. Our money transfers, in and out of South Africa, are done in strict accordance with money laundering regulations and exchange control regulations and all our transactions are audited in terms of our licence and banking requirements.

South Africa Exchange Control Regulations

Although not unique to South Africa very few countries now operate a system of control (exchange control regulations) over money movement in and out of the country (currency exchange).

South Africa Exchange Control regulations ‘control’ the flow of money both in and out of South Africa. They effect every transaction, no matter what amount of rand gets transferred and who the sender or recipient of the money is.

The Reserve Bank of South Africa controls and oversees all capital in – and outflows. The Reserve Bank designates power to so called authorised dealers who oversee and regulate the market on their behalf.

Currency trading companies, such as ourselves, will trade via these authorised dealers, but due to the effect of bulking transfers, are able to offer better rates and do not have to charge money transfer service fees.

Key points of the South Africa exchange control regulations

  • It is applicable to all transactions no matter the size.south africa exchange control regulations
  • No resident may effect a transfer without prior approval.
  • No company or legal entity may effect a transfer without prior approval.
  • Only authorised dealers are allowed to effect a currency transfer.
  • Outward payments may only be made for permissible reasons and under conditions that are approved by the authorised dealers on behalf of the Reserve Bank.
  • All payments made to foreign parties must be reported to the Reserve Bank.
  • There are set amounts for personal transfers in the form of allowances that must be adhered to.

How do exchange control regulations effect me?

For individuals the South African exchange control regulations dictates how much and under what circumstances you may transfer money out of South Africa. It should be noted that the exchange control regulations apply to South African residents, not citizens or permanent residence holders. Therefore if you are considered a resident for exchange control purposes, they are applicable to you. Residency is defined in a number of different ways and expert opinion as to your circumstances should be sought from a company such as ours.

Permissible reasons for transfers abroad include:

  • Monetary gifts and loans.
  • Donations to missionaries.
  • Maintenance transfers.
  • Travel allowance.
  • Study allowance.
  • R 1 million foreign capital allowance.
  • R10 million individual capital allowance.

For companies any payments that need to be made to a foreign party are covered by the regulations. Similar in effect to personal transfers abroad companies are required to justify why they need to remit money to a foreign party and seek approval form the Reserve Bank or where empowered the authorised dealer. Exchange control regulations cover all payments and investment abroad made by a company, and loans made by overseas investors to a South African resident.

Summary

Exchange control regulations are in-depth and complex, you can read them in full here. They change constantly and compliance is essential. Let Incompass be your guide through the maze of exchange control regulations by calling us + (27) 21 424 2936 or emailing us here.

South Africa Exchange Control – Process and Players

South Africa operates a system of exchange control over the flow of money into and out of South Africa. For every money transfer that is effected exchange control plays a role. Below we look at some of the processes and players in how foreign exchange control works.

Players

  • The Reserve Bank of South Africa – Is empowered by the presidency in terms of overseeing and regulating certain matters that directly or indirectly relate to or affect or have any bearing upon currency, banking or exchanges
  • Authorised dealers – Their function is to assist the Financial Surveillance Department in administering exchange control. All applications to the Financial Surveillance Department have to be made through an authorised dealer. In other words: all currency transactions must go through authorised dealers, however and importantly you do not have to trade your currency through them.
  • Currency Companies – Currency companies, such as Incompass, work with authorised dealers. They are able to get better rates and do not charge administration fees through a process of bulking. In practise this means that due to the large amount of trades that we transact we are able to provide more competitive rates of exchange as well as expertise due to specialising.

Process

  • Role of Incompass – as a currency company we deal with you the client, our remit is to provide you with the best advice, most competitive exchange rates and deal with issues such as the below, free of charge.Learning about exchange control - process and players
  • Compliance – aside from the normal obligations to money laundering regulations, currency transfers need to be effected in accordance with the relevant Exchange Control legislation. There are different rules governing the transfer of money into South Africa and the transferring of money out of South Africa. Which rules and regulations are applicable to you depends on your residency status. In short, a failure to comply with these rules can result in taxation issues and problems with the repatriation of funds. It is imperative that a currency company with full knowledge of Exchange Control regulations is used and it is unlikely that experts outside of South Africa will have this knowledge.
  • Money transferred to South Africa – both, South African based companies and ones based abroad, can effect a transfer to South Africa. There is little doubt hat either will be more cost effective than utilising a bank for your transfer and that the exchange rate received will be better. However, with currency companies abroad there is often a lack of knowledge around compliance issues as above and often the all important paper trail is not fully understood. In addition, in most cases there is no knowledge regarding the declaration of incoming funds and assets. It is essential when transferring money into South Africa that both of these elements are dealt with properly to avoid taxation and repatriation issues.
  • Repatriating funds introduced – firstly to dispel a myth often boasted on websites and by those ignorant of Exchange Control regulations – it is not the case that all money transferred into South Africa can be repatriated. But it is also not true that funds that were introduced to South Africa can never be transferred back again. To repatriate funds clearance must be obtained from the authorised dealer (and possibly the Reserve Bank). Repatriation depends on a number of criteria that includes but is not limited to:
    • Why, when and how the funds were transferred to South Africa;
    • Residency status;
    • How long you have been in South Africa;
    • Tax status.

In the instance of repatriating funds it is highly unlikely that any currency company that is not based in South Africa will be able to assist you.
